Information to WINDTRE customers in the event of termination of a fixed-line contract

You can withdraw from your WINDTRE business fixed-line contract at any time.

Before withdrawing from the contract, we recommend that you first check the duration of the contract on the General Terms and Conditions you have signed. As a rule, the duration of the contract is 24 (twenty-four) months from its conclusion. Thereafter, where possible, it is tacitly renewed from year to year, unless notice of termination is given by PEC or registered letter with acknowledgement of receipt, at least 30 (thirty) days prior to its expiry. The duration shall be calculated individually for each Access/SIM Card.

At any time, it is possible to withdraw by notifying WINDTRE BUSINESS by means of a PEC or registered letter with acknowledgement of receipt; withdrawal shall take effect thirty days from the date of receipt of the relevant notice.

In the event of early termination of the fixed network contract, you will be required to pay a fee for disconnection, as partial reimbursement of the costs incurred by WINDTRE; the cost of this fee is indicated in the "Annexes" of the signed Contract. 
WINDTRE has the right to subordinate the granting of discounts and/or promotions on the amounts due for the various services offered, to the maintenance of the contract, for a certain duration established on the basis of the promotional offer. 
In this case, in the event of withdrawal prior to the expiry of the minimum duration provided for by the individual promotional offers, you shall be required to pay an amount corresponding to the discounts or the value of the promotion from which you benefited, as provided in the "Annexes" to the undersigned Contract.

In the event of cancellation of the fixed network offer prior to the contractual expiry date, the Customer shall in any case be required to pay the residual amount due for the product or for any equipment purchased, as set forth in the relevant contract. Payment shall be made in accordance with the terms expressed by the Customer at the time of signing the contract, or modified at a later date, either by debiting all the remaining instalments due in a single instalment, including the final instalment, if any, or by maintaining the instalment payment until the natural expiry date.

Finally, if the Customer has contracted Advanced Technical Assistance, this service has a duration of 24 months, starting from the date of its completion, and is automatically terminated at the end of this term.
It is possible to withdraw at any time by means of a written request to be sent by PEC or registered letter with return receipt.
In the event of termination of the Contract for subscription mobile telephony services or for rechargeable SIM cards and/or the Contract for the purchase of products/equipment in instalments, the Contract for Advanced Technical Assistance services shall also be deemed automatically terminated.

In the case of partial withdrawal from the Subscription Contract or for rechargeable SIM cards and/or from the contract for the purchase of products/equipment in instalments, it is necessary to inform Wind Tre S.p.A, by PEC or registered letter with return receipt, on which terminals you intend to discontinue the Advanced Technical Assistance Service, indicating the appropriate IMEI codes; if you do not do so, Wind Tre S.p.A. reserves the right to continue to provide the Advanced Technical Assistance Service on the various terminals, and consequently, the Customer will be required to pay the relevant Advanced Technical Assistance fee.

All notices of withdrawal must be signed by the Legal Representative/Delegate, or by the Official Receiver and/or the Liquidator, and addressed to:

For the greater protection of the Customer and exact identification, any request for withdrawal must be accompanied by a copy of a valid identity document of the applicant and signatory.

Please note that - in the case of both mobile and fixed lines being active - the Customer's withdrawal may concern either the mobile offer only or the fixed offer only or both lines. It is therefore necessary for the Customer, in his or her withdrawal request, to specify exactly what he or she wants in order to avoid one or the other line remaining active in the event that the intention to withdraw concerns both.

Furthermore, as from 01/05/2023, the Wind Tre fixed network Customer, in all cases of termination of the contract entered into with Wind Tre, has the right, pursuant to Article 98-octies decies, paragraph 3, of the Electronic Communications Code (Legislative Decree no. 259/2003 as amended by Legislative Decree no. 207/2021) to transfer the numbering(s) ceased following the termination of the contract to another operator within and no later than 60 (sixty) days from the date of termination of the said contract, unless he/she waives this right.
